Cancellation Policy

At THC Edibles AU, we understand that circumstances can change. This Cancellation Policy explains when you may request cancellation of an order and how cancellation requests are handled.

This policy should be read together with our Terms & Conditions, Shipping & Delivery Policy, and Returns & Refunds Policy.

Nothing in this policy is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law.

1. Cancelling an Order

If you need to cancel an order, please contact us as soon as possible after placing the order.

Cancellation requests should be sent to:

  • Your full name

  • Order number

  • Email address used for the order

  • Reason for cancellation, where applicable

  • Any other information reasonably required to identify the order

We will make reasonable efforts to process eligible cancellation requests before the order enters processing or dispatch.

2. Cancellation Before Dispatch

If your cancellation request is received before your order has been dispatched, we may be able to cancel the order.

Where cancellation is accepted before dispatch, we will arrange any applicable refund to the original payment method, subject to applicable law and our payment-processing procedures.

A refund may take additional time to appear in your account depending on your bank or payment provider.

3. Orders Already Dispatched

Once an order has been dispatched, we may not be able to cancel it.

If your order has already been dispatched, please contact us and explain the circumstances.

Depending on the circumstances, we may direct you to our Returns & Refunds Policy.

Any statutory consumer rights that apply to the order remain unaffected.

4. Change-of-Mind Cancellations

Australian Consumer Law does not generally require a business to provide a refund simply because a customer changes their mind about an online purchase.

THC Edibles AU may therefore limit change-of-mind cancellations to orders that have not yet been processed or dispatched.

Where we voluntarily accept a change-of-mind cancellation, any applicable conditions will be communicated to the customer before the cancellation is finalised.

5. Cancellation Due to Product Problems

A cancellation may be available where a product has a problem covered by the Australian Consumer Law.

Depending on the nature and seriousness of the problem, Australian Consumer Law may provide rights to a repair, replacement, refund or cancellation.

Examples may include goods that:

  • Are unsafe;

  • Are substantially different from their description;

  • Are not of acceptable quality;

  • Do not match a sample or demonstration model; or

  • Have another problem covered by the consumer guarantees.

These rights are separate from any voluntary change-of-mind policy.

6. Major Product Problems

Where a product has a major failure under the Australian Consumer Law, eligible consumers may have the right to choose a refund or replacement.

A major problem can include circumstances where goods are unsafe, substantially different from their description, or cannot reasonably be used for their normal purpose.

If you believe your order has a major problem, please contact us promptly so that we can assess the issue and provide the appropriate remedy.

7. Minor Product Problems

Where a product has a problem that does not amount to a major failure, we may be entitled to provide an appropriate remedy such as repair or replacement, depending on the circumstances.

If the problem cannot be resolved within a reasonable time, additional remedies may become available under the Australian Consumer Law.

8. Cancellation by THC Edibles AU

We may need to cancel an order where we are unable to lawfully or reasonably fulfil it.

Circumstances may include:

  • The ordered product is unavailable;

  • A product has been incorrectly listed;

  • Payment cannot be verified;

  • The delivery destination cannot be serviced;

  • Age or eligibility requirements cannot be satisfied;

  • Legal or regulatory requirements prevent fulfilment;

  • The order contains inaccurate or incomplete information;

  • We reasonably suspect fraudulent or unauthorised activity; or

  • An event outside our reasonable control prevents fulfilment.

If we cancel an order after payment has been received, we will arrange any applicable refund in accordance with applicable law.

9. Incorrect Customer Information

Customers are responsible for ensuring that information supplied during checkout is accurate.

This includes:

  • Name;

  • Delivery address;

  • Email address;

  • Contact information; and

  • Payment information.

If an order cannot be fulfilled because incorrect information was supplied, cancellation and refund arrangements may depend on whether the order has already been processed or dispatched.

10. Age or Eligibility Verification

Because products offered through our website may be subject to age, eligibility and regulatory requirements, we may cancel an order where required verification cannot be completed.

Passing an age-verification screen does not necessarily establish that a particular customer is legally eligible to purchase or receive a particular product.

Where an order cannot legally be fulfilled, we may cancel the order and provide any applicable refund.

11. Refunds Following Cancellation

Where a refund is approved, refunds will generally be made to the original payment method used for the transaction.

The time required for a refund to appear in your account may depend on your bank, card issuer or payment provider.

We are not responsible for delays caused solely by a customer’s financial institution or payment provider.

12. Promotional Orders

If an order containing a promotional discount is cancelled, the refund calculation may depend on the terms of the relevant promotion.

Any promotional terms presented at the time of purchase will continue to apply, subject to applicable consumer rights.

We recommend contacting us as soon as possible because orders may move into processing or dispatch shortly after payment is confirmed.

14. Consumer Guarantees

Nothing in this Cancellation Policy removes or limits consumer guarantees that apply under the Australian Consumer Law.

The ACCC confirms that consumer guarantees apply to online purchases and that businesses cannot use a store policy or terms and conditions to remove a consumer’s rights relating to faulty goods.

Australian Consumer Law Notice

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

15. Changes to This Policy

We may update this Cancellation Policy from time to time to reflect changes to our business practices, products, payment services or applicable legal requirements.
